DRAFT IMMIGRATION ACT AMENDMENT BILL ENTERS ITS FINAL PHASE


The Draft Immigration Act Amendment Bill last week entered the Parliamentary Portfolio Committee phase which is a forerunner to the Bill being presented to Parliament for finalisation on the 27th August 2004.

Stakeholders and the general public were given an opportunity to give written or verbal input into the process. I had the privilege of presenting the Law Society’s input on the technical aspects of the Draft Bill and was also part of the Business Unity South Africa (BUSA) delegation which made a presentation from organised business.

The proposed amendments are predominantly technical of nature but will also have a host of practical implications.

It is my intention to deal with all of these changes once the Bill has become law, in a series of articles which will be published in this article and elsewhere (all to be made available on this website).

The Minister has appointed a Task Team to revisit and redraft the Regulations in terms of the Immigration Act and this is currently in progress. The Director-General, when addressing the Parliamentary Portfolio Committee on Monday the 2nd August 2004 stated that:

“It should be noted that although this does not appear from the Amendments, the Regulations will be published and public comment will be solicited”.

This means that the Draft Regulations will still have to be published and public comment solicited before there can be finalisation of the regulatory process.

As soon as the Draft Regulations come to hand we will publish, and keep you informed of the intended changes.
