CAPE HIGH COURT SETS ASIDE COURT ORDER THEREBY PREVENTING THE "FINAL" IMMIGRATION REGULATIONS FROM COMING INTO FORCE ON 7TH APRIL 2004



In a dramatic move in a judgement of the Court on the 6th April 2004, Judge Hennie Erasmus set aside the Court order of the 8th March 2004 which had effectively caused Home Affairs Minister Buthelezi to gazette the final Regulations.

As a direct result of this Court order the "final" Regulations gazetted on 8th March 2004 were set aside.

Effectively this means that the Regulations gazetted on the 21st February 2003 and which came into force on the 7th April 2003 remain the Regulations in force.
